Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Allswap website, applications, and related services (collectively, the "Service") operated by Allswap ("Allswap," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Allswap is an AI-powered platform that helps creators, brands, and agencies create media, automate workflows, connect social accounts, schedule content, and publish across supported social platforms. Features may include AI video and image generation, character tools, lip sync, motion control, workflow automation, analytics, and related tools. We may add, change, or discontinue features at any time.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your account details up to date.

You may sign in using email verification or supported third-party authentication providers. You are responsible for ensuring that anyone who accesses the Service through your account complies with these Terms.

You retain ownership of content you upload, create, schedule, or publish through the Service ("User Content"), subject to the licenses below. You represent and warrant that you have all rights necessary to use, upload, generate, modify, and publish User Content through the Service, including any likeness, voice, trademark, or copyright permissions required.

By using the Service, you grant Allswap a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and distribute User Content solely as needed to operate, improve, secure, and provide the Service, including publishing to connected third-party platforms at your direction.

The Service may generate text, images, video, audio, or other outputs using artificial intelligence. AI outputs may be inaccurate, incomplete, or unsuitable for your intended use. You are solely responsible for reviewing, approving, and using AI-generated content before publishing or distributing it.

You agree not to use the Service to create or distribute unlawful, harmful, deceptive, infringing, or otherwise prohibited content, including content that violates the rights of others or the policies of connected social platforms.

The Service may allow you to connect third-party social media accounts and publish content on your behalf. When you connect an account, you authorize Allswap to access and use platform data as needed to provide scheduling, publishing, analytics, and related features. Your use of those platforms remains subject to their own terms and policies.

We are not responsible for actions taken by third-party platforms, including content removals, account restrictions, API changes, outages, or policy enforcement.

You agree not to:

• violate any applicable law or regulation;
• infringe intellectual property, privacy, publicity, or other rights;
• upload malware, attempt unauthorized access, or interfere with the Service;
• scrape, reverse engineer, or misuse the Service except as permitted by law;
• use the Service to send spam, impersonate others, or engage in fraudulent activity;
• resell or sublicense the Service without our prior written consent.

We may investigate violations and suspend or terminate access where appropriate.

Certain features require a paid subscription, usage credits, or other fees. Prices, plans, and billing terms are presented at checkout or in your account settings. Payments are processed by our third-party billing provider. By purchasing a plan, you authorize us and our billing partners to charge your selected payment method on a recurring basis where applicable.

Unless otherwise stated or required by law, fees are non-refundable. We may change pricing with reasonable notice. Failure to pay may result in suspension or loss of access to paid features.

The Service, including its software, branding, design, documentation, and underlying technology, is owned by Allswap or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

The Service integrates with third-party providers for authentication, email delivery, analytics, hosting, payments, AI processing, and social platform APIs. Your use of those services may be subject to separate terms and privacy practices. Allswap is not responsible for third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT PUBLISHING OR AI OUTPUTS WILL MEET YOUR EXPECTATIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLSWAP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ALLSWAP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

You agree to defend, indemnify, and hold harmless Allswap and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your connected social accounts, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk for us or other users, or where required by law. Upon termination, provisions that by their nature should survive will remain in effect.

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws applicable in the jurisdiction where Allswap operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.
